Loss or failed delivery or damage in transit or short shipment

The Company shall not be responsible or liable for any claims arising from the delivery of its products by courier services selected by the buyer/Recipient during the online ordering process. Any claims related to loss, failed delivery, damage in transit, or short shipment shall be transferred by the Company to the courier selected by the Recipient, who shall remain solely liable for its services under its own terms and conditions, as accepted by the Recipient at the time of ordering.

The Company accepts no responsibility or liability:

    • For insured or non-insured shipments that are not delivered, lost, or fail to clear Customs, including cases in which Customs clearance is denied for any reason, including (without limitation) the non-acceptance by Customs authorities of 3Dresyns legal policies previously accepted by the Recipient, such as: Acceptance of 3Dresyns non-disclosure of confidential compositional information in Material Safety Data Sheets (MSDSs) .
    • For damaged products or short shipments when the courier delivery receipt has been signed without remarks (“clean receipt”). By signing a clean receipt, the Recipient releases the courier from liability for missing or damaged goods, including insured shipments. In such cases, the Company will not be able to assist the Recipient in filing a claim with the courier.

The Recipient must inspect the shipment before accepting delivery. If packaging damage or missing products are observed, the Recipient must refuse to sign a clean receipt and must clearly state in writing on the courier’s delivery documentation:

“Shipment packaging is damaged and/or products are missing, detailing the missing product references and quantities.”

In such cases, all packaging materials must be retained, and the Recipient must notify the Company in writing within three (3) working days of delivery in order for the Company to transfer the claim to the courier. Couriers will reject and will not accept claims that are not initiated within the required time limits.

Insurance notice: Courier services available during online ordering are not insured. If the Recipient wishes to insure all or part of the shipment value, an insured delivery quotation must be requested by email at info@3Dresyns.com before placing an online order. In such cases, the Company will issue a quotation and a proforma invoice for insured delivery, which must be accepted prior to shipment.

    Customs, duties, and import compliance

The Recipient is solely responsible for compliance with all applicable import, customs, regulatory, and legal requirements in the destination country, including but not limited to licenses, permits, registrations, certifications, duties, taxes, and fees.

The Company shall not be responsible or liable for any delays, losses, failed deliveries, seizures, returns, or destruction of shipments resulting from Customs inspections, regulatory restrictions, import prohibitions, incorrect or incomplete documentation, or non-compliance with local laws or regulations.

Any additional costs arising from Customs procedures, including but not limited to storage fees, demurrage, penalties, duties, taxes, re-export, return, or re-shipment costs, shall be borne exclusively by the Recipient.

The Recipient acknowledges and accepts that certain products may be subject to restrictions, limitations, or additional requirements depending on the destination country and agrees to verify and comply with such requirements prior to placing an order.

    Force majeure

The Company shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, strikes, labor disputes, governmental actions, changes in laws or regulations, Customs restrictions, transportation disruptions, supply chain shortages, power failures, or failures of telecommunications or information systems.

In the event of a force majeure situation, the Company shall be entitled to suspend, postpone, or cancel the affected obligations, in whole or in part, without liability for damages.

If a force majeure event continues for an extended period, the Company reserves the right to terminate the affected order or service, in whole or in part, without incurring any liability toward the Recipient.
