Permission to publish
The customer, the “Recipient”, shall refrain from publishing, presenting, disclosing, or otherwise communicating to any third party any research results, testing data, performance evaluations, comparisons, or conclusions related to 3Dresyns products without the prior written consent of 3Dresyns, the “Company”.
This obligation applies to all forms of publication, including but not limited to scientific papers, technical reports, conference presentations, posters, abstracts, online publications, marketing materials, press releases, and oral disclosures.
Before any submission or disclosure, the Recipient shall provide the Company with the complete manuscript or material intended for publication or presentation (hereinafter, the “Publication”) at least thirty (30) calendar days prior to submission to any journal, conference, reviewer, publisher, or third party.
The Company shall have the right to review the Publication in order to assess its impact on its ownership of contents, reputation, confidential information, trade secrets, intellectual property, and industrial or commercial interests, as well as the appropriateness of the testing methodology and interpretation of results.
If, within fifteen (15) calendar days of receipt of the Publication, the Company notifies the Recipient that the Publication raises concerns, the Recipient shall use best efforts to modify the Publication accordingly prior to any disclosure.
If the Company does not respond within thirty (30) calendar days of confirmed receipt of the Publication, and provided that the Recipient can demonstrate documented and unsuccessful attempts to obtain a response, permission to publish shall be deemed granted.
