Ownership of contents

Ownership and permitted use of contents

Content created, developed, owned, or lawfully controlled by 3Dresyns by Resyner Technologies S.L. (the “Company”) may be protected by copyright, database rights, trademark rights, trade-secret protection, contractual confidentiality obligations, industrial property rights, and other applicable legal protections.

Protected Company content may include, where applicable:

  • technical documentation;
  • Technical Data Sheets (TDSs), Instructions for Use (IFUs), guides, manuals, and protocols;
  • non-public Curing Rate Tables (CRTs), calibration methodologies, and technical data;
  • training materials;
  • scientific, technical, and commercial texts;
  • original graphics, photographs, renders, illustrations, videos, and audiovisual materials;
  • website content and original page structures or compilations;
  • presentations and reports;
  • proprietary databases and structured technical information;
  • non-public research and development information;
  • proprietary formulations, processes, methodologies, and know-how;
  • Company trademarks, trade names, and brand assets; and
  • other original, proprietary, confidential, or protected materials created or lawfully controlled by the Company.

Company communications

Emails, technical communications, presentations, video calls, conference calls, messaging-platform communications, reports, attachments, quotations, and other communications from the Company may contain copyrighted material, Confidential Information, trade secrets, proprietary technical information, personal data, or other protected content.

The mere receipt of such a communication does not transfer ownership of the Company's intellectual property, Confidential Information, proprietary know-how, or other protected rights to the Recipient.

However, not every individual communication or item of information is necessarily protected by the same intellectual-property or confidentiality rights. Protection depends on the nature of the relevant content, the applicable contractual obligations, and applicable law.

Limited use by customers and Recipients

Unless different terms apply to particular content, the Company permits a Buyer or Recipient to use Company documentation and content reasonably necessary for the legitimate internal use, evaluation, processing, validation, storage, handling, or application of Products or Services lawfully supplied to that Buyer or Recipient.

This limited permission is non-exclusive, non-transferable except where reasonably necessary within the Buyer's organization for the authorized purpose, and does not transfer ownership of the underlying intellectual property or Confidential Information.

Internal use may include, where appropriate:

  • reviewing Product documentation;
  • using technical instructions to process or evaluate a purchased Product;
  • sharing necessary documentation internally with personnel involved in the authorized use of the Product;
  • retaining documentation for quality, regulatory, purchasing, safety, or record-keeping purposes; and
  • providing documentation to professional advisers or competent authorities where legitimately required.

Restricted uses

Except where authorized by the Company, permitted by an applicable licence, required by law, or otherwise legally permitted, the Recipient shall not use protected Company content in a manner that infringes the Company's intellectual-property, trade-secret, confidentiality, or other rights.

Prohibited uses may include, where applicable:

  • commercial reproduction or redistribution of protected Company documentation;
  • publication of non-public Company technical materials;
  • removal or alteration of copyright, confidentiality, trademark, or proprietary notices;
  • sale, sublicensing, or commercial exploitation of proprietary Company documentation;
  • unauthorized copying or distribution of confidential CRTs, calibration data, or non-public technical information;
  • use of Company Confidential Information to develop or reproduce proprietary formulations or competing technology;
  • publication of Company trade secrets or information subject to an NDA or other valid confidentiality obligation; and
  • use of Company trademarks, logos, or brand assets in a manner that falsely implies authorization, sponsorship, certification, endorsement, or partnership.

Publicly accessible Company publications

Certain Company documents are made publicly accessible and may be deposited with a permanent Digital Object Identifier in the Company's Zenodo community. These currently include the 3Dresyns Technical White Paper Series, the 3Dresyns Engineering Reviews, the 3Dresyns materials property datasets, and any other document that the Company expressly identifies as publicly accessible at the point of publication.

Unless the Company expressly grants a separate written licence, those publications are made publicly accessible on an All Rights Reserved basis. Public accessibility, free viewing or downloading, and DOI assignment do not transfer ownership and do not grant permission to reproduce, redistribute, translate, adapt, modify, republish, commercially exploit, create derivative works from, or otherwise reuse the protected content except where permitted by applicable law or by the Company's prior written consent.

Public accessibility grants no right in the Company's trademarks, trade names or brand assets, no patent or other industrial property right, no right in the Company's Confidential Information, trade secrets, proprietary formulations, raw material grades, supplier identities or compositional data, and no right to reverse engineer a Company Product.

The public availability of a document does not render non-confidential any information that the Company has not published. Where a publicly accessible document and a Technical Data Sheet published on the Website differ, the Technical Data Sheet governs.

Confidential information and trade secrets

Where Company content constitutes Confidential Information or a protected trade secret, its use and disclosure are additionally governed by the Company's Confidentiality policy, Prohibition against reverse engineering and penalties, and any applicable NDA or other written confidentiality agreement.

Receipt of Confidential Information for a particular purpose does not authorize its use for another purpose, disclosure to unauthorized third parties, reproduction of proprietary technology, or commercial exploitation outside the authorized scope.

Customer-generated and independently generated content

Purchase or use of a 3Dresyns Product does not, by itself, transfer to the Company ownership of original content independently created by a customer or third party.

Subject to any separate written agreement, independently generated research data, testing results, scientific conclusions, reports, photographs, publications, or other original material created by a customer remain subject to the rights of their respective authors or owners.

This does not authorize the inclusion or disclosure within such material of Company Confidential Information, trade secrets, proprietary compositional information, protected Company content, or other information subject to a valid contractual restriction.

Publication and disclosure issues are governed further by the Company's Permission to publish and disclosure of results policy.

Third-party content

The Website or Company documentation may contain content, references, trademarks, links, standards, publications, photographs, or other material owned by third parties.

Such third-party content remains subject to the rights and terms applicable to its respective owner and is not claimed as exclusive property of the Company merely because it appears on or is referenced through the Website.

Quotations, references, and legally permitted uses

Nothing in this policy prohibits quotation, reference, reproduction, analysis, disclosure, or another use that is expressly permitted by mandatory applicable intellectual-property law or another legal exception that cannot validly be restricted.

Where Company content is lawfully quoted or referenced, the source should be identified where required by applicable law and the material must not be presented in a misleading manner or falsely attributed to the Company.

Artificial intelligence and external processing systems

Company Confidential Information, protected trade secrets, proprietary formulations, non-public technical documentation, confidential CRT information, unpublished technical data, or other information subject to a confidentiality restriction must not be uploaded, submitted, disclosed, or otherwise made available to an unauthorized external artificial intelligence system, large language model, machine-learning platform, analytical service, or comparable third-party processing system.

This restriction applies regardless of whether the external system is used for training, querying, summarization, translation, extraction, comparison, analysis, classification, transformation, generation of derivative material, or another processing purpose.

Removing the Company name or other obvious identifiers does not make the disclosure permissible where the underlying information remains confidential, proprietary, or capable of revealing a protected trade secret.

This section concerns Confidential Information and other non-public Company content. Publicly accessible Company publications remain subject to the rights and restrictions applicable to those publications, including All Rights Reserved where stated.

Further requirements concerning AI-assisted and third-party processing of Confidential Information are governed by the Company's Confidentiality policy.

Publicly available Company content and automated analysis

Public availability of Company content on the Website does not, by itself, mean that intellectual-property rights in that content have been waived or that the content has been placed in the public domain.

This section applies to Company content that is publicly accessible on the Website or through an external repository. Public accessibility does not, by itself, grant a licence for reuse, text and data mining, automated extraction, artificial-intelligence training, or other computational use.

To the extent permitted by applicable law, the Company reserves its rights in relation to unauthorized commercial reproduction, extraction, reuse, systematic copying, creation of competing databases, or other exploitation of protected Website content.

Any reservation of rights concerning automated text and data analysis, machine learning, or similar computational use shall apply only to the extent recognized and enforceable under applicable law and without restricting statutory exceptions or rights that cannot lawfully be excluded.

Artificial intelligence training and model development

Company Confidential Information and trade secrets may not be used for training, fine-tuning, retrieval systems, datasets, model development, evaluation datasets, or comparable artificial-intelligence purposes without the Company's prior written authorization where such use would breach an applicable confidentiality, trade-secret, contractual, or intellectual-property obligation.

For publicly available Website content, any restriction on text and data mining, automated extraction, or AI-related use is subject to the requirements and exceptions established by applicable intellectual-property law.

For publicly accessible Company publications, permitted uses are those allowed by applicable law, by any express licence stated by the Company, or by prior written authorization from the Company.

Modification and derivative use

Permission to use Company documentation for its intended internal purpose does not authorize a Recipient to modify that documentation and redistribute the modified version as official 3Dresyns documentation.

No modified, translated, summarized, or derivative document may be represented as an official Company document unless it has been issued or expressly approved by the Company for that purpose.

This does not prevent internal notes, translations, summaries, or adaptations made for legitimate internal use where they do not disclose protected information unlawfully or create a false representation of Company approval.

Public availability of a Company document does not authorize adaptation or redistribution. Any modification, translation, adaptation, redistribution, republication, or derivative use that requires permission under applicable law requires the Company's prior written consent unless a separate express licence applies. No modified or derivative document may be presented as an official Company document or as endorsed by the Company.

Publication and public disclosure

Public disclosure of Company Confidential Information, protected trade secrets, proprietary technical information, or non-public Company-owned materials requires the authorization required under the applicable confidentiality or contractual framework.

Independently generated research, testing results, scientific conclusions, and other third-party intellectual output are governed by the Company's Permission to publish and disclosure of results policy and are not subject to prior Company approval merely because they concern a 3Dresyns Product.

Trademarks and logo

The names 3Dresyns and associated trademarks, logos, trade names, and brand assets remain subject to the Company's applicable trademark and brand rights.

Use of the Company's logo is governed by the Use of logo policy.

Purchase of a Product or Service does not, by itself, authorize use of Company trademarks or branding in a manner that implies sponsorship, certification, endorsement, partnership, or commercial affiliation.

Truthful identification of the Company as author, publisher, supplier, or source does not, by itself, imply sponsorship, endorsement, certification, or partnership.

No transfer of intellectual property

Except where expressly agreed in writing, purchase of Products or Services does not transfer to the Buyer ownership of the Company's underlying formulations, technology, know-how, trade secrets, documentation, calibration methodologies, software, intellectual property, or other proprietary rights.

Any rights granted to the Buyer are limited to those reasonably necessary for the authorized use of the purchased Product or Service and any additional rights expressly granted in writing.

Enforcement

Unauthorized use, reproduction, disclosure, extraction, distribution, or commercial exploitation of protected Company content may constitute a breach of contract, infringement of intellectual-property rights, unlawful acquisition or disclosure of trade secrets, or another actionable wrong depending on the circumstances.

The Company may pursue the contractual and legal remedies available under applicable law where such conduct occurs.

Relationship with other Legal Terms

This policy must be read together with the Company's:

Where an NDA, license, research agreement, technology-transfer agreement, development agreement, or other individually negotiated written contract establishes different ownership or use rights, the provisions of that agreement shall prevail in relation to the matters specifically governed by it.

Mandatory rights

Nothing in this policy excludes, restricts, or modifies any copyright exception, statutory use, disclosure, legal remedy, or other right that cannot lawfully be excluded or restricted.
