Governing law and jurisdiction

Governing law

The Company's Legal Terms, policies, contractual conditions, and contracts for Products and Services shall be governed by and construed in accordance with the laws of Spain, except where mandatory applicable law provides otherwise.

Business Buyers

For Business Buyers, any dispute, claim, or controversy arising out of or in connection with the Company's Products, Services, orders, contracts, Legal Terms, or related commercial relationship shall be subject to the exclusive jurisdiction of the competent Courts of Donostia / San Sebastián, Gipuzkoa, Spain, to the fullest extent permitted by applicable law.

This jurisdiction clause applies unless a different forum has been expressly agreed in an individually negotiated written agreement or mandatory applicable law requires otherwise.

Consumers

Where the Buyer qualifies as a Consumer, the choice of Spanish law shall not deprive the Consumer of any mandatory protection available under the law applicable to the Consumer pursuant to mandatory national or European Union rules.

Any dispute involving a Consumer shall be subject to the courts having jurisdiction under the mandatory rules applicable to that Consumer. Nothing in these Legal Terms requires a Consumer to submit exclusively to the Courts of Donostia / San Sebastián where applicable law gives the Consumer the right to bring or defend proceedings in another competent court.

Mandatory jurisdiction and applicable law

Nothing in this policy overrides any mandatory rule concerning applicable law, jurisdiction, venue, or access to judicial remedies that cannot lawfully be modified by agreement between the parties.
